This Performance Audit report examined how the Ministry of Constitution and Legal Affairs (MoCLA) has managed the provision of legal aid services to indigent persons in Tanzania. It reviewed whether MoCLA has ensured accessibility, delivery, quality, and coordination of legal aid between 2021/22 and 2024/25, in line with the Legal Aid Act, 2017 and related regulations.
The audit highlights gaps such as uneven distribution of providers, weak registration and oversight systems, inadequate support for paralegals and desk officers, and poor coordination across stakeholders, which collectively limit access to justice for vulnerable populations. It concludes that, despite legal frameworks and initiatives such as the Mama Samia Legal Aid Campaign, MoCLA has not established effective mechanisms to ensure nationwide, high-quality, and equitable legal aid services.
The recommendations urge MoCLA to strengthen registration systems, improve funding and oversight, introduce quality assurance frameworks, and build a national coordination platform to harmonise efforts among providers, civil society, and government institutions, ensuring that indigent populations can meaningfully access justice.
